Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Stashbase website (stashbase.io), the Stashbase dashboard at app.stashbase.io, the Stashbase API, and any related services (collectively, the "Service"). The Service is operated by eMariners Inc, a company incorporated in Dubai, United Arab Emirates ("Stashbase", "we", "us", or "our").

By creating an account, accessing, or using the Service, you ("you", "Customer") agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. The Service

Stashbase provides a hosted backend platform built on Postgres, PostgREST, and GoTrue. We give each project a dedicated Postgres schema, an auto-generated REST API, authentication, a dashboard, and daily backups. Specific limits per pricing tier are described on our pricing page and may change with notice.

2. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for:

  • Maintaining the confidentiality of your credentials and any API keys issued to you;
  • All activity that occurs under your account, including activity by your users and downstream applications;
  • Providing accurate billing and contact information.

Notify us at admin@stashbase.io immediately if you suspect unauthorised use of your account.

3. Acceptable Use

You agree not to use the Service to:

  • Store or transmit unlawful content, malware, or material that infringes the rights of others;
  • Process payment card data (PCI scope) or protected health information (PHI) unless you have a separate written agreement with us covering that use case;
  • Attempt to gain unauthorised access to other tenants, the underlying infrastructure, or any other systems;
  • Reverse engineer, decompile, or attempt to extract source code, except to the extent expressly permitted by applicable law;
  • Use the Service to send unsolicited bulk communications, run open relays, mine cryptocurrency, or perform other activity disproportionate to the resources of your pricing tier;
  • Resell or sublicense the Service without our prior written consent.

We may suspend or terminate accounts that violate this section. Severe violations (e.g., illegal content) may be acted on without notice.

4. Customer Data & Ownership

As between you and us, you own your Customer Data (the data, schemas, and content you upload to or generate via the Service). You grant us a worldwide, royalty-free licence to host, process, transmit, back up, and display Customer Data solely as needed to operate the Service.

We do not sell Customer Data, do not use it to train AI models, and do not use it for advertising. We process personal data on your behalf as described in our Privacy Policy, which forms part of these Terms.

Where the EU General Data Protection Regulation (GDPR) or the UK GDPR applies, we act as the data processor and you act as the data controller for Customer Data. A Data Processing Addendum (DPA) is available on request for paid customers.

5. Data Portability & Export

You can export your data at any time, including via one-click pg_dump from the dashboard or by directly connecting with the Postgres credentials we provide. We commit not to engineer artificial barriers to export.

6. Fees, Billing & Refunds

Paid plans are billed in advance on a recurring monthly or annual basis. Fees are non-refundable except where required by law. If you upgrade or downgrade mid-cycle, we will prorate the change on the next invoice. Taxes (including UAE VAT where applicable) may be added to the listed price.

We may revise pricing with at least 30 days' notice. If you don't accept the new pricing, you can cancel before the change takes effect.

7. Backups, Availability & Service Levels

We perform daily off-site backups of all projects with 30-day retention. The hosted Service is provided on a commercially reasonable best-efforts basis. We do not commit to a formal uptime SLA on Free, Starter, or Pro tiers — Enterprise customers may negotiate one in writing.

8. Suspension & Termination

You may cancel at any time from your dashboard. We may suspend or terminate your account for: (a) non-payment after notice, (b) material breach of these Terms, (c) suspected fraud or abuse, or (d) where required by law.

Upon termination, we retain your data for 30 days in case you wish to reactivate, after which it is permanently deleted from production systems. Backups containing your data continue to age out under their 30-day retention.

9. Intellectual Property

The Service, including the dashboard, marketing site, branding, and proprietary code (excluding open-source components, which remain under their respective licences), is and remains the property of eMariners Inc. Nothing in these Terms grants you any rights in our trademarks.

10. Third-Party Services & Subprocessors

We use a small number of vetted subprocessors to operate the Service (e.g., cloud hosting, object storage for backups, transactional email). The current list is published in our Privacy Policy and updated when it changes.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR USD 100, WHICHEVER IS GREATER).

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability arising from gross negligence, wilful misconduct, or fraud.

13. Indemnity

You agree to indemnify and hold harmless eMariners Inc and its directors, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of your Customer Data, your use of the Service, or your breach of these Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, to the extent applicable. The courts of Dubai, UAE have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that we may seek injunctive relief in any court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the dashboard or by email at least 30 days before they take effect. Continued use of the Service after a change indicates your acceptance.
